Requirements
Irrespective of the complexity or diversity of MTAs, research institutions will have to have an administrative system to track all materials and knowledge that is used in the course of its research. Biotechnologists tend to do this to a large extent in order to be able to write scientific papers – they commonly concentrate on the methodologies and not on the origin of the materials used. Plant breeders commonly keep track of the pedigrees in their breeding programmes, mainly to increase the efficiency of their work. The names of the landraces or parent varieties are commonly recorded, but not where the ideas came from to make particular crosses (local knowledge?).

Similar to the use of third party intellectual property, scientists need to know what the restrictions are on the use of each genetic resource used in their breeding programmes plus the source of the traditional knowledge that they included in their decision making processes.

To regulate the transfer and use of PGR within the GCP, the programme has formulated a Consortium Agreement: "Agreement to establish a consortium for the Generation Challenge Program: Cultivating Plant Diversity for the Resource-poor"

Please study Part F of the agreement on Background Intellectual Property (page 17 and further) and answer the following questions:
  1. Please list:
    1. the IP issues that are currently prevailing.
    2. the IP issues to be included in the future institutional policy of your organization, and
  2. Define an IP plan on the basis of the key IP issues. LINK …… Bart hier komt nog een interne link naar het IP plan. Heb ik nog niet.
  3. Carefully read ‘Part F’ of the GCP consortium agreement and research to what extent your own IP Plan matches the GCP consortium agreement, i.e. list the differences and overlaps.
